WESTERN DIGITAL PROPOSES SETTLEMENT IN CLASS-ACTION SUIT
Western Digital has proposed a settlement in a class action suit
brought against it. At issue is the claimed capacity of its hard
drives. There are two different ways to measure a gigabyte. So when a
drive is installed, it often appears to have a smaller capacity.
As with any class-action suit, the details are a bit cumbersome. But,
if you purchased a hard drive from Western Digital between March 22,
2001, to Feb. 15, 2006, you're eligible to join the suit. If the
settlement is approved, you'll receive software to help you back up
your data. Details are posted on Western Digital's site:
http://www.wdc.com/settlement
The important dates for you to know are:
May 19, 2006 is the deadline to opt-out of this settlement;
May 24, 2006 is the deadline to intervene or object to this settlement;
June 14, 2006 is the Final Approval hearing date; and
Thirty days after Final Approval is the deadline to complete the Claim Form to receive the Class Benefit.
The Class Benefit will become available to eligible class members following the Effective Date of the settlement, as desribed in the Settlement Agreement. The Effective Date depends on such factors as the pendency of any appeals and is therefore difficult to predict.
